Federal Judge Orders Release of Abrego Garcia from ICE Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks lawful basis.
"Since his release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken removal to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to answer alien smuggling allegations, he was held in immigration detention.
In her order, the court pointed out that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
Context of the Case
The legal challenge involve disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in Tennessee.
